An electronic document sent after 17:00 (fax: after 15:00), on a Friday or on a rest day is deemed served on the next weekday.
Recess

How are the days counted under the regulations?

The count starts on the day the document was served, or, if the decision was given at a hearing in the presence of the parties, on the hearing date (regulation 179(a)). That day itself is not counted, and the count starts on the next day (section 10(a) of the Interpretation Law). The days are calendar days, including Saturdays and holidays in the middle of the period.

When are the court recesses?

Under the Courts (Recess) Regulations, 5743-1983, there are three recesses a year: the Sukkot recess, from 14 to 22 Tishri; the Pesach recess, from 14 to 21 Nisan; and the summer recess, from 21 July to 5 September. Recess days are not counted in periods set by the regulations or by the court, unless the court orders otherwise (regulation 179(b)). The Sukkot and Pesach recess dates change every year according to the Hebrew calendar, and the calculator works them out for each year.

What happens when the last day falls on a Friday, a Saturday or a holiday?

A Friday that is the last day for filing is treated as a recess day (regulation 4 of the Recess Regulations), and a Saturday, holiday or recess at the end of the period extends it (section 10(c) of the Interpretation Law). So the deadline moves to the first following day that is none of these, usually a Sunday.

When is a document sent through Net Hamishpat deemed served?

For electronic sending, the time of service is the time it was sent. A document sent after 17:00 Sunday to Thursday, on a Friday or on a rest day is deemed served on the next weekday (regulation 161(1)(d)). For fax the cut-off is 15:00, and for registered mail the day of service is the date stated on the delivery confirmation (regulation 161).

How long is there to file a statement of defence?

60 days from service of the statement of claim; 120 days in a medical negligence claim; 45 days in the fast track; and 30 days in a claim to evict a tenant (regulations 9(b), 80(a) and 81(b)).

How long is there to file an appeal?

60 days from service of the decision, also for a motion for leave to appeal (regulation 137(a)). Recess days are not counted.

Does the calculator account for extensions?

No. An extension by consent or by decision, and any other time set by the court, override the calculation and should be checked in the case file.
