A defect in the lobby or on the roof: who sues?
Defects in the common property in a 30-second video
Video transcript
This time Sidki settled on the shared roof. Defects in the roof, the lobby and the parking garage belong to everyone, so the building's representative body sues on behalf of all the buyers. In a case we handled in Rehovot, with about 100 buyers, the developer paid 2,978,750 ₪ in a settlement, and the representative body carried out the repairs itself, with a contractor chosen in advance.
Full explanation: A representative body's claim for defects in the common property: the case of some 100 purchasers. Construction defects in the lobby, roof and car park of a new building? How the representative committee sues the developer, why money is sometimes better than repairs, and what was achieved in a case we handled.
